K20,000.00 in the form of bank draft made in favour of DynastyDevelopment Limited.The said Earnest Money (Tender Deposit)will beforfeited in the event that a tenderer refuse to sign the contract after histender has been accepted or if he withdraws his tender before expiry of thetender validity period.The Earnest Money of all unsuccessful tenderers,subject to receipt of a bonafide tender and return of all Tender Drawings and Document,will bedischarged free of interest after expiration of the tender validity period orafter the tender has been awarded to the successful tenderer whichever is Schedules shall be duly filled in and no changeshall be made to the wordings thereof.Any corrections shall be made clearlyand initialed by the Tenderer's authorized representative signing the tender.The Employer does not hold himself responsible for loss or misplacement ofloose documents.Mutilated or defaced tender forms may be rejected.g)The work or service for which this tender will be received shall be carried outin accordance with the Drawings as specified together with the GeneralConditions of Contract,Specifications,Schedules and such further drawingsand instructions as will be issued during the performance of this work.h)1)The tenderer shall state in his tender a firm Lump Sum for thoroughcompletion of the works as shown and described in the drawings and allcontingencies and liabilities to which he is or may become liable under thesaid Drawings,Bills of Quantities,Schedules,General Conditions of Contractand Specifications.The price quoted by the tenderer for the contract shall befirm during the performance of the contract.The contract sum will not besubject to any price adjustment due to fluctuation or hike in prices or rates ofmaterials,labour,plant,fuel,transport and duties.2)The SUM above should account for all terms and conditions as laid downin the Drawings,Bills of Quantities,Schedules,General Conditions ofContract and Specifications.Any clarifications which the tenderer wishes tomake must be stipulated in a covering letter and not at the back of the TenderForm or elsewhere.The tenderer shall also present documentary evidencethat he is qualified,experienced and has the necessary technical and financialcapabilities to perform the contract if his tender proposal is acceptedThe tenderer whose tender is accepted shall when required enter into aformal contract with the Employer for the due execution of the Works.j)The tender will remain open for acceptance for a period of one hundredtwenty(120)days from the day the tenders close.2.The Employer does not bind himself to accept the lowest or any tender.TheEmployer may annul the Tendering process and reserves the right to reject anyTender for any reason whatsoever without thereby incurring any liability to anyTenderer and without being required to offer any explanation for such action.The Employer reserves the right to waive any irregularity in any Tendersubmitted.Any Tender considered by the Employer as being unacceptable orunresponsive will be rejected.Illegal or unethical conduct or attempts toinfluence the Employer's evaluation of the table document.The tender table document and drawings could beviewed during office hours at the office of the Architect.4.All Tenderers must at their own expenses visit and examine the site to obtain forthemselves all information that may be necessary to compile the tender;AllTenderers must examine carefully the Tender Documents in order to ascertain allmatters which are required and satisfy themselves the risks and obligations theyare to undertake.5.By virtue of submitting his Tender,the Tenderer asserts that he has,on his ownresponsibility and at his own expenses,inspected and examined the site and itssurrounding,public utilities and installations in or around the site,existingamenities,structures and infra works and including other matters relevant to theexecution of the Works and obtained all the information which are considerednecessary for the purpose of tendering.The tenderer shall be deemed to havesatisfied himself as to the form,nature,constraints and limitation of the site,theextent,nature,practicality and difficulties of the Work,the extent of temporary,protective and precautionary works required,the means of access andtransportation,the availability of materials,labours,plants and equipment,thenature of the soil and strata in or on which the Works is to be constructed,roadtraffic conditions,weather conditions,country or location conditions and ingeneral shall satisfy himself and obtain all necessary information as to the risk,contingencies,and other circumstances which may influence or affect its Tenderand to have taken the same into consideration and made adequate allowancestherefore in his Tender.6.If the Tenderer is in doubt as to the true meaning of any part of the TenderDocuments or Drawings,he should at once notify the Architect in writing andrequest clarification before the date fixed for receiving tenders.Any clarificationgiven out will be valid only if made by the Consultant by means of a formal letter.7.Prior to the specified tender closing,the Consultant may issue Addenda to clarify,modify or amend the Tender Documents.A set of each Addendum will be issuedto every Tenderer and the Addendum shall become part of the TenderDocuments.Receipt of each Addendum must be acknowledged on the formissued with the Addendum.8.The Employer will not be responsible or pay for any expenses incurred by thetenderer in
